Terms of Service

CreWave is an online platform for discovering and publishing job opportunities in the yachting and marine industry.

CreWave is a job-posting and job-discovery platform only. CreWave is not:

• ●an employer
• ●a recruitment agency
• ●a crewing agency
• ●a hiring representative
• ●an employment broker
• ●a party to any employment contract between users and employers

CreWave does not hire crew on behalf of employers and does not guarantee that any user will obtain employment or that any employer will find suitable candidates.

By using CreWave, you confirm that:

• ●you are legally able to enter into binding agreements
• ●the information you provide, if any, is accurate and not misleading
• ●you will use the platform only for lawful purposes

If you use CreWave on behalf of a company, agency, yacht owner, or other entity, you represent that you have authority to bind that entity to these Terms.

CreWave only provides a platform through which job opportunities may be displayed and discovered.

CreWave does not:

• ●verify every employer, agency, candidate, or listing
• ●screen users for honesty, qualifications, solvency, licensing, or legitimacy
• ●negotiate salary, benefits, work conditions, visas, rotation, or contract terms
• ●supervise the hiring process
• ●participate in interviews, hiring decisions, or employment disputes
• ●guarantee job availability, employer responsiveness, or candidate suitability

Any relationship, agreement, dispute, or transaction between a user and an employer, recruiter, yacht owner, management company, or agency is solely between those parties.

Job posts, salary details, position descriptions, locations, benefits, and contact information may come from third parties, including owners, agencies, yacht managers, employers, public sources, submissions, or other external channels.

CreWave does not warrant or guarantee that any listing is:

• ●accurate
• ●complete
• ●current
• ●lawful
• ●still available
• ●free from errors, omissions, or misleading statements

A listing on CreWave does not constitute an endorsement, recommendation, guarantee, or certification by CreWave.

Users are solely responsible for carrying out their own due diligence before applying for, accepting, offering, or promoting any position.

Some job listings may include AI-generated salary estimates labeled as "AI Est."

These estimates are generated using internal comparisons to yacht industry compensation benchmarks and other listing-related signals available to CreWave at the time.

AI salary estimates:

• ●are informational only
• ●are not guaranteed
• ●are not promises or offers of compensation
• ●may be incomplete, inaccurate, outdated, or inapplicable to a specific role

Actual pay may vary significantly depending on vessel size, itinerary, ownership structure, experience, certifications, duties, contract type, tax treatment, and employer choice.

CreWave is not responsible for any difference between an AI estimate and the actual salary or benefits offered.

You use CreWave at your own risk.

You are solely responsible for:

• ●evaluating the legitimacy of listings, agencies, and employers
• ●verifying salary, work conditions, licenses, visas, certificates, and legal requirements
• ●protecting your personal information
• ●deciding whether to contact or respond to a listing
• ●reviewing any contract before signing it
• ●obtaining professional legal, immigration, tax, employment, or financial advice where needed

CreWave is not responsible for scams, fraud, impersonation, false claims, phishing attempts, misrepresentation, non-payment, unsafe working conditions, illegal hiring practices, or any loss arising from interactions initiated through the platform.

CreWave makes no guarantee that:

• ●you will receive interview requests
• ●you will be hired
• ●a listing will remain active
• ●an employer will respond
• ●any subscription will lead to employment
• ●any feature will improve your hiring chances
• ●any employer will fill a vacancy through CreWave

Any statements about outcomes, success stories, or platform benefits are descriptive only and are not guarantees of future results.

Certain features of CreWave may only be available through a paid subscription or paid plan.

By purchasing a subscription or paid feature, you agree that:

• ●you are authorizing payment for the selected plan
• ●prices, billing cycles, and included features may vary by plan
• ●access to some content or contact details may be limited to paying users
• ●CreWave may change pricing, features, plan structure, or eligibility at any time for future billing periods

Unless otherwise stated, subscriptions may renew automatically on a recurring basis until cancelled.

It is your responsibility to review the plan details before purchasing.

You may cancel your subscription at any time. Cancellation prevents future renewals only.

Unless expressly required by applicable law, cancellation does not:

• ●reverse a completed payment
• ●create a refund right
• ●entitle you to prorated reimbursement
• ●entitle you to credit for unused time
• ●entitle you to compensation for features not used

Access to paid features may continue until the end of the current billing period, unless CreWave suspends or terminates access under these Terms.

• ●no refunds will be issued after payment is successfully processed
• ●no partial refunds will be issued for unused time
• ●no refunds will be issued for accidental purchases
• ●no refunds will be issued because a user forgot to cancel
• ●no refunds will be issued for dissatisfaction, lack of job offers, lack of employer responses, or perceived platform value
• ●no refunds will be issued because a listing expired, changed, or was removed
• ●no chargebacks or payment reversals may be initiated without a valid legal basis

If a user files an improper chargeback or payment dispute after receiving access to paid features, CreWave reserves the right to suspend or permanently block access and pursue recovery of associated costs where legally permitted.

Nothing in this section limits any non-waivable consumer rights that apply under mandatory law.

Payments may be processed by third-party providers. CreWave does not control third-party payment systems and is not responsible for payment processor outages, failures, delays, verification issues, banking issues, or processor errors.

By making a purchase, you may also be subject to the terms and privacy policies of the relevant payment provider.

Eligible referrals may earn a $3 reward for an Access Monthly subscription or a $5 reward for an Elite Monthly subscription after the referred user’s second confirmed successful monthly payment.

Annual plans do not qualify. Refunded payments do not count before payout. CreWave records qualification and payment status, while rewards are paid manually through PayPal to the payout email supplied by the referrer.

CreWave may review, reject, suspend, or correct referral rewards affected by fraud, self-referral, duplicate accounts, payment reversals, or inaccurate information.

Promotional program, subject to change or withdrawal. The referral program is a promotional offer and not a permanent feature of the platform. CreWave may modify, suspend, or terminate the program, change reward amounts, or change eligibility rules at any time, at its sole discretion, with or without prior notice. Changes take effect when posted on this page.

If the program is modified or terminated, rewards already qualified (meaning the referred user’s second confirmed successful monthly payment was completed before the change took effect) will still be paid. Any referral that has not yet qualified at that time is forfeited, regardless of any referral in progress, and no claim to an unqualified reward survives termination.

Manual payment. All rewards are reviewed and paid manually by CreWave. Nothing on the platform sends money automatically. A reward is not owed until CreWave has verified eligibility and issued the payment. Payout timing is at CreWave’s reasonable discretion and no specific payment date is guaranteed.

Valid payout account required. The referrer must supply a valid PayPal account able to receive payments. If a qualified reward cannot be delivered within 90 days because no working payout account has been supplied, the reward lapses.

Nature of rewards. Rewards are personal, non-transferable, carry no interest, and have no cash value beyond the stated amount. Rewards are not wages, salary, commission, or compensation for services, and participation does not create any employment, agency, contractor, or partnership relationship with CreWave.

Fees and taxes. Any PayPal receiving fees or currency conversion costs are borne by the recipient. The recipient is solely responsible for reporting and paying any taxes applicable to rewards received.

Final determination and disputes. CreWave’s determination of eligibility, qualification, and fraud is final. Any question regarding a reward must be raised in writing within 30 days of the relevant payout decision, after which that decision is final.

CreWave may state that a portion of subscription-related revenue or a fixed amount per active subscription supports ocean cleanup initiatives.

Unless explicitly stated otherwise on the platform at the relevant time:

• ●CreWave determines the supported initiative or organization at its discretion
• ●donations may be made periodically rather than instantly upon each purchase
• ●supported organizations may be changed at any time
• ●temporary delays, administrative adjustments, currency conversion differences, reversals, failed payments, fraud prevention actions, and subscription cancellations may affect the final donated amount

Such statements reflect CreWave's general mission and allocation model and do not create a trust, escrow, fiduciary duty, or individual donation right in favor of any user.

You agree not to:

• ●post or submit false, deceptive, unlawful, or misleading information
• ●impersonate any person, yacht, company, or agency
• ●use CreWave to scam, harass, exploit, or solicit users improperly
• ●upload, transmit, or distribute malicious code
• ●interfere with platform security or operations
• ●scrape, copy, harvest, frame, mirror, crawl, or extract data from the platform without written permission
• ●use bots, automation, or scripts to access protected parts of the service unless expressly authorized
• ●reproduce or republish listings or site content in bulk
• ●violate any law, regulation, sanction, export restriction, or third-party right

CreWave reserves the right, at any time and at its sole discretion, with or without notice, to:

• ●edit, refuse, suspend, remove, or delete any listing or content
• ●restrict or terminate access to any user
• ●block IP addresses, devices, payment methods, or accounts
• ●investigate suspected misuse
• ●cooperate with law enforcement or legal process where required

CreWave is not obligated to publish, maintain, or restore any content.

Job posts may expire automatically, including after a limited posting period such as 4 days, if such expiration rules apply on the platform.

CreWave may also:

• ●modify listing presentation
• ●reformat submitted content
• ●add labels such as salary estimates or metadata
• ●remove outdated or incomplete listings
• ●correct spelling, grammar, formatting, or categorization

CreWave is not responsible for any consequence of a listing expiring, changing, becoming unavailable, or being removed.

CreWave may include links, emails, websites, application forms, social profiles, WhatsApp numbers, third-party tools, and external services.

CreWave does not control and is not responsible for third-party sites, communications, content, products, services, privacy practices, terms, or security.

Once you leave CreWave or contact a third party, you do so at your own risk.

All rights, title, and interest in and to CreWave, including its name, logo, branding, layout, design, software, text, graphics, databases, AI-enhanced formatting, and original content, are owned by or licensed to CreWave and protected by applicable intellectual property laws.

Except as expressly allowed in writing, you may not:

• ●copy, modify, or distribute
• ●sell, sublicense, or reverse engineer
• ●republish or commercially exploit

any part of the platform or its content.

If you submit ideas, suggestions, improvements, comments, or feedback to CreWave, you agree that CreWave may use them without restriction or compensation to you.

Your use of CreWave is also subject to the Privacy Policy.

To the maximum extent permitted by law, CreWave disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

CreWave does not warrant that:

• ●the service will be uninterrupted or error-free
• ●listings will always be accurate or up to date
• ●defects will be corrected
• ●the platform or servers will be free of malware or harmful components
• ●access will always be secure

To the maximum extent permitted by law, CreWave and its owners, operators, affiliates, personnel, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, income, data, goodwill, business opportunity, contracts, or reputation arising out of or related to:

• ●your use of or inability to use the platform
• ●job listings or third-party content
• ●interactions with employers, agencies, or candidates
• ●employment decisions or disputes
• ●fraud, phishing, scams, or misconduct by third parties
• ●subscription purchases or payment issues
• ●platform outages, delays, or changes
• ●unauthorized access to communications or data

This limitation applies even if a remedy fails of its essential purpose.

You agree to defend, indemnify, and hold harmless CreWave and its owners, affiliates, operators, personnel, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising from or related to:

• ●your use of the platform
• ●your violation of these Terms
• ●your misuse of listings or user information
• ●your unlawful conduct
• ●content or information you submit, post, or transmit
• ●disputes between you and any third party

CreWave may modify, suspend, discontinue, or restrict any part of the platform at any time, with or without notice. This includes changes to:

• ●pricing and subscriptions
• ●listing visibility and filters
• ●contact access
• ●AI features and design
• ●supported regions or categories

CreWave is not liable for any modification, suspension, or discontinuation of the service.

CreWave may update these Terms from time to time.

The updated version becomes effective when posted on the platform unless otherwise stated. Your continued use of CreWave after updated Terms are posted means you accept the revised Terms.

These Terms are governed by the laws of the jurisdiction in which the operator of CreWave is established, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to CreWave or these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction, unless mandatory law requires otherwise.

If any provision of these Terms is found unlawful, invalid, or unenforceable, the remaining provisions will remain in full force and effect.

Failure by CreWave to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

These Terms and the Privacy Policy constitute the entire agreement between you and CreWave regarding use of the platform and supersede any prior understandings relating to that use.
